Software Patente stellen ein beträchtliches Risiko für Open Source Software, Internet Standards und den Wettbewerb dar! Das EU Parlament will dank der Proteste erst frühestens am 22.09. über Software Patente entscheiden, was noch Zeit zum handeln läßt.

Hier ein paar Meinungen zu Software- und Logik Patenten:

FFII In den letzten Jahren hat das Europische Patentamt (EPA) gegen den Buchstaben und Geist der geltenden Gesetze über 30.000 Patente auf computer-implementierte Organisations- und Rechenregeln (Programme für Datenverarbeitungsanlagen) erteilt. Nun möchte Europas Patentbewegung diese Praxis durch ein neues Gesetz festschreiben. Europas Programmierer und Bürger sehen sich beträchtlichen Risiken ausgesetzt.

W3C By now, most of those reading this know of the recent court case of Eolas v. Microsoft in regards to US Patent 5,838,906. The patent claims to cover mechanisms for embedding objects within distributed hypermedia documents, where at least some of the object's data is located external to the document, and there is a control path to the object's implementation to support user interaction with the object. The implementation can be local or distributed across a network, and is automatically invoked based upon type information in the document or associated with the object's data. CCC Der Chaos Computer Club e.V. (CCC) fordert die Amazon.de GmbH und Amazon.com, Inc. auf, das "Geschenke verschicken"-Patent freiwillig aus dem Patentregister wieder löschen zu lassen. Das Europäische Patentamt (EPA) in München hat kürzlich der Firma Amazon ein Patent erteilt, das alle computerisierten Verfahren der bestellten Lieferung von Geschenken an Dritte umfasst.

Attac Attac protestiert gegen geplante Softwarepatente in der EU. Die geplanten Software-Patente begünstigen nach Ansicht von Attac große Unternehmen, die über die notwendigen finanziellen Ressourcen verfügen.Erfahrungen aus den USA zeigten zudem, dass bereits ein einzelnes Patent bei entsprechendem Zuschnitt einen ganzen Markt blockieren kann.

Deutscher Linux Verband Aktuell wird in der Bundesrepublik und in Europa die politische Debatte um die Einführung von Logikpatenten nach US-Vorbild geführt. Hier spricht sich der Linux-Verband für eine Lösung aus, welche die Interessen der mittelständischen europäischen IT-Firmen schützt und die Entwicklung Freier Software fördert anstatt sie massiv zu behindern, wie es der aktuelle Richtlinienentwurf der EU-Kommission zur Folge hätte.
